On a 41-19 vote, the House agreed to ask Congress to approve a constitutional amendment defining marriage as between one man and one woman.

HCM2004 follows a Massachusetts Supreme Court ruling that said gays in that state can marry. The Arizona Supreme Court is considering a similar lawsuit.

Rep. John Loredo, DPhoenix, said the measure is being pushed by those who see gay weddings as an attack on marriage. But he said that, as a straight man, nothing gays do affect heterosexual couples.

But Rep. Steve Tully, RPhoenix, said the move is necessary because of activist judges.

"There is no effective check on the unconstitutional acts of the court," he said.

The measure goes to the Senate.
