A Mountain Pointe graduate was shot and killed by Buckeye police early Monday morning after entering a backyard armed with a gun.

Cody Shobe, 21, apparently walked into a backyard in Buckeye around 12:45 a.m. carrying a gun, said Assistant Chief Larry Hall of the Buckeye Police Department. About eight people were gathered at the residence for a small party on Monday when Shobe let himself in. None of the partygoers knew Shobe.

"He was armed with a 9-millimeter semi-automatic pistol," Hall said. "When he showed up he displayed the weapon to everyone there. He was waving it around and pointing it at different people, which prompted one of the partygoers to call 911."

Police responded and set up a perimeter around the house. Two officers went to an upstairs bedroom where they could see Shobe from above. Hall said officers had a good safe perimeter set up and most of the partygoers had safely made it inside the home but one person was still outside with Shobe, trying to talk him into putting his weapon down.

Police made their presence known and asked Shobe again to drop his weapon.

"He appeared agitated, paranoid and possibly under the influence," Hall said, though police are waiting for toxicology reports to know for sure if Shobe was under the influence.

Negotiations continued for about a half hour, but Shobe refused to drop his weapon and eventually shot at the officers in the second floor of the house. At that time officers were forced to return fire, Hall said. Despite medical efforts, Shobe was dead at the scene.

It was still unknown why Shobe entered the residence.

Shobe grew up in Ahwatukee Foothills and was married in April, according to his Facebook page. At the time of the shooting he was living in Buckeye.
