Judge denies new grand jury in missing baby case

A Scottsdale woman who wanted to adopt an Arizona baby that's still missing has been denied a request for new grand jury.

The Arizona Republic says a second grand jury would have heard the state's evidence against Tammi Peters Smith and considered whether it warrants charges.

The 38-year-old Smith is released on bond on charges of forgery and conspiracy to commit custodial interference.

The baby's mother, Elizabeth Johnson, remains jailed on charges of kidnapping, child abuse, conspiracy to commit custodial interference and custodial interference.

Gabriel Johnson was 8 months old when he was last seen in December 2009 in San Antonio. Police don't know whether the boy is alive.

Elizabeth Johnson was arrested in Florida on Dec. 30, 2009.
