Court denies Arpaio's bid to reconsider pink underwear ruling

A court has rejected Maricopa County Sheriff Joe Arpaio's request to reconsider its ruling that criticized jail officers' decision to force pink underwear onto a mentally ill inmate who erroneously believed jailers were trying to rape him.

A three-judge panel of the 9th Circuit Court of Appeals on Friday denied Arpaio's request to have a larger panel of justices reconsider the court's March decision.

A jury verdict in favor of Arpaio's office was thrown out and a new trial was ordered in a lawsuit by inmate Eric Vogel's estate.

The estate's attorney has said the officers didn't sexually assault Vogel when he was brought to jail in 2001 for assaulting an officer, but Vogel thought he was being raped.

    Read that sentence again. Joe's goons force a mentally ill inmate to wear pink underwear. And Joe thinks that's ok and wants the courts to agree with him.

    And precisely how were Joe's officers supposed to KNOW the individual was mentally ill?
    Prisoners pull all kinds of things trying to get out of their fix or get away with something.
    Is each officer working in the jail supposed to be a licensed psychiatrist now?
    No one wants to wear the pink underwear and I imaging the jail officers have seen a lot of different excuses etc. by prisoners trying to avoid the pink underwear over the years.
    Were officers supposed to just say " oh well he doesn't want to wear the pink underwear so let him be " ?
    Hell, every prisoner in the place would be resisting if this prisoners resistance were allowed to get him out of wearing the stuff.
    No whether or not prisoners < should > be required to wear pink underwear is subject for another debate, jailers could not reasonably be expected to know the individual was mentally ill just because he resisted the pink underwear and refused to put it on.
    There are probably quite a few drunk and or defiant prisoners who refuse to put it on when they get put in the slammer.
