Complaint about Mesa recall hopeful turned aside

PHOENIX (AP) — The Arizona Secretary of State's Office is turning away a Democratic Party activist's complaint about a Mesa woman's candidacy in the Nov. 8 recall election for state Senate President Russell Pearce.

Robert McDonald Jr. had asked the office to investigate the campaign of Republican Olivia Cortes, saying she hadn't made required disclosures and that her candidacy was a sham intended to divert votes from another candidate in the race.

Election Director Amy Chan's response says alleged technical violations with signs and disclosures either don't apply to Cortes or are in the purview of local officials.

Chan also says the office doesn't have authority to evaluate a candidate's motives and that any remedy for McDonald about his complaint that Cortes is a sham candidate would be a matter for the courts.
